1. Overview

This website is operated by Eclipse.

Throughout these Terms of Service, the terms “Eclipse,” “we,” “us” and “our” refer to the operator of the Eclipse online store. Eclipse provides this website, including its information, content, features, products and related services, subject to these Terms of Service.

Our store is hosted by Shopify, which provides the e-commerce platform that enables us to offer our products to customers.

These Terms of Service, together with our Privacy Policy, Return and Refund Policy and Shipping Policy, govern your access to and use of our website and your purchases from Eclipse.

By visiting our website, creating an account or placing an order, you agree to these Terms. If you do not agree with them, you should not use the website or place an order.

Nothing in these Terms excludes, restricts or replaces any mandatory consumer right available to you under applicable law.

2. Eligibility and Accounts

You must be at least the age of legal majority in your country or have the permission and supervision required by applicable law to use this website or make a purchase.

You agree to provide accurate, current and complete information when placing an order or creating an account.

You are responsible for:

  • maintaining the confidentiality of your account details;

  • restricting access to your account and devices;

  • promptly informing us of suspected unauthorised access;

  • ensuring that your billing, shipping and contact information is correct.

You may not sell, transfer or assign your account to another person.

We may suspend or restrict an account where we reasonably suspect fraud, misuse, unauthorised activity or a violation of these Terms.

3. Product Information

We take reasonable care to ensure that product descriptions, photographs, measurements, colours and other information are accurate.

However:

  • colours may appear differently depending on the customer’s screen and device settings;

  • garment measurements may have minor manufacturing tolerances;

  • placement, print texture and finish may vary slightly between individual units;

  • packaging may change without affecting the product itself.

These minor differences do not affect your statutory rights where a product is defective, materially misdescribed or does not conform to the contract.

Product photographs and lifestyle images may include styling, props or accessories that are not included unless expressly stated in the product description.

Customers should review the relevant product description and size guide before ordering.

We may correct genuine errors in product information and update or discontinue products without prior notice. Changes will not affect orders already accepted, except where necessary to correct an obvious error or comply with law.

4. Product Availability

All products are subject to availability.

Adding an item to a cart does not reserve it. A product may sell out before checkout is completed.

We may limit quantities purchased per customer, household, payment method, address or order where reasonably necessary to:

  • protect limited releases;

  • prevent unauthorised resale;

  • manage inventory;

  • prevent fraud or abuse;

  • comply with legal restrictions.

Where a paid product becomes unavailable, we will contact the customer and provide an appropriate refund.

5. Orders and Contract Formation

Placing an order constitutes an offer to purchase products from Eclipse.

After an order is submitted, we may send an acknowledgement confirming that we received it. This acknowledgement does not necessarily mean that the order has been accepted.

An order is accepted when we:

  • send an order-confirmation or fulfilment confirmation; or

  • otherwise clearly confirm acceptance of the order.

We may refuse or cancel an order before acceptance where reasonably necessary, including because of:

  • unavailable inventory;

  • an obvious pricing or product error;

  • unsuccessful or reversed payment;

  • suspected fraud or unauthorised activity;

  • delivery restrictions;

  • suspected commercial resale;

  • legal or regulatory requirements.

If payment has already been collected for an order we do not accept, the relevant amount will be refunded.

6. Order Changes and Cancellations

Customers may request an order cancellation or amendment within one hour after placing the order, provided fulfilment or production has not already begun.

Requests must be sent promptly to support@eclipseunknown.com and must include the order number.

We cannot guarantee that a cancellation or amendment request will be completed, even when sent within one hour, because fulfilment may begin immediately.

Once an order has entered fulfilment, it generally cannot be intercepted, amended or cancelled before delivery. The customer must wait until the order is delivered and then follow our Return and Refund Policy where eligible.

This operational cancellation rule does not restrict any mandatory statutory withdrawal right.

7. Prices

Prices are displayed in the currency selected or shown at checkout.

The price charged will be the price displayed at checkout when the order is placed, subject to correction of obvious errors.

Unless clearly stated otherwise at checkout, prices shown to customers include applicable VAT or similar consumption taxes that Eclipse is required to collect.

Shipping charges and any other permitted charges will be displayed before the customer submits the order.

Where Eclipse states that duties and import taxes are included, those charges are included in the checkout total and should not ordinarily be collected separately upon delivery.

Where taxes, customs duties or import charges cannot be included for a particular destination, this will be disclosed before the order is completed where required by law.

We may change product prices at any time. Price changes do not affect already accepted orders.

8. Pricing Errors

Although we take reasonable care, a product may occasionally be listed with an obvious pricing, discount or description error.

Where an error is obvious and could reasonably have been recognised as a mistake, we may contact the customer to:

  • confirm the order at the correct price; or

  • cancel the affected item and provide a refund.

We will not increase the price of an accepted order merely because the product later becomes more expensive.

9. Promotions and Discount Codes

Promotions, discount codes and special offers may be subject to separate conditions, including:

  • validity dates;

  • product exclusions;

  • minimum spending requirements;

  • customer eligibility;

  • limits on the number of uses;

  • restrictions against combining offers.

Discount codes have no cash value and cannot be exchanged for money.

We may cancel or refuse discounts obtained through fraud, technical exploitation, unauthorised publication or misuse.

Mandatory consumer rights continue to apply to discounted products.

10. Payment

Available payment methods are displayed at checkout.

You represent that:

  • the payment information you provide is accurate;

  • you are authorised to use the selected payment method;

  • sufficient funds or credit are available;

  • the payment is not fraudulent or unauthorised.

Payments may be processed by Shopify Payments or other third-party payment providers. Their services may be subject to additional terms and privacy notices.

We do not directly retain complete payment-card information where payment is handled by an authorised payment provider.

An order may be delayed or cancelled where a payment is declined, reversed, disputed or flagged for additional verification.

11. Fraud Prevention and Verification

To protect customers and Eclipse, we may conduct reasonable fraud-prevention checks.

We may request additional information necessary to verify:

  • the customer’s identity;

  • authorisation of the payment;

  • the billing or shipping address;

  • unusual order activity.

Customers should not send full card details, passwords or highly sensitive identification documents by ordinary email unless we have provided a secure and appropriate method.

We may refuse or cancel an order where verification cannot reasonably be completed.

12. Shipping

Orders are shipped in accordance with our Shipping Policy.

Delivery dates and transit periods are estimates unless we expressly guarantee a specific date.

Estimated delivery may be affected by:

  • order processing;

  • production requirements;

  • carrier operations;

  • destination-country procedures;

  • customs clearance;

  • weather;

  • public holidays;

  • incorrect customer information;

  • events outside our reasonable control.

We will not use this clause to exclude any mandatory rights relating to delayed or failed delivery.

13. Delivery and Risk of Loss

For consumer orders, Eclipse remains responsible for the goods until they are physically received by the customer or a person designated by the customer, except where applicable law provides otherwise.

Risk may pass earlier where the customer independently appoints a carrier that was not offered by Eclipse.

A parcel marked as delivered by the carrier may be investigated where the customer reports that it was not received.

Customers must contact support@eclipseunknown.com promptly regarding a missing delivery and cooperate with reasonable carrier investigations.

14. Customer Shipping Information

Customers are responsible for providing a complete and accurate:

  • recipient name;

  • delivery address;

  • apartment or unit number;

  • postcode;

  • telephone number;

  • email address.

Eclipse is not responsible for delays caused solely by inaccurate or incomplete information supplied by the customer.

Where an order is returned, lost or requires reshipment because of an incorrect address, failure to collect or failure to cooperate with delivery, the customer may be responsible for the actual additional costs incurred, to the extent permitted by law.

Customers should contact us immediately after noticing an address error. We cannot guarantee that an address can be changed once fulfilment has begun.

15. Customs and Cross-Border Delivery

International orders may be subject to customs processing.

Where duties and import taxes are expressly stated as included, customers should not normally be required to pay them separately.

Customers must provide reasonable information requested by the carrier or customs authority where necessary to complete delivery.

Eclipse is not responsible for delays caused by the customer’s failure to provide required delivery or customs information.

Customers should contact us before paying an unexpected customs charge where the checkout stated that duties were included.

16. Returns, Refunds and Exchanges

Returns, refunds and exchanges are governed by our Return and Refund Policy, which forms part of these Terms.

Our Return and Refund Policy explains:

  • the applicable return period;

  • eligibility requirements;

  • return shipping responsibilities;

  • non-returnable products;

  • damaged or incorrect orders;

  • statutory withdrawal rights;

  • refund processing.

Nothing in that policy or these Terms removes mandatory rights relating to defective, damaged or non-conforming goods.

17. Legal Guarantee and Product Conformity

Products must conform to the contract and to the descriptions and representations provided when the order was placed.

Consumers may have mandatory legal rights where goods:

  • are defective;

  • are not as described;

  • do not possess the advertised qualities;

  • are not suitable for their ordinary purpose;

  • are not delivered with the expected accessories or instructions.

Customers in the European Union benefit from the mandatory legal guarantee applicable under EU and national law, which is generally at least two years for new consumer goods.

Depending on the circumstances and applicable law, available remedies may include:

  • repair;

  • replacement;

  • price reduction;

  • termination of the contract and refund.

Any commercial warranty offered by a manufacturer or other party is additional to, and does not replace, statutory consumer rights.

18. Product Care

Customers should follow the product’s care label and any care instructions supplied with the product.

Eclipse is not responsible for damage caused by:

  • washing contrary to the care instructions;

  • excessive heat;

  • bleach or unsuitable chemicals;

  • unauthorised alteration;

  • accidental damage;

  • misuse;

  • ordinary wear and tear.

This does not affect rights relating to an inherent defect or lack of conformity existing when the product was delivered.

19. Intellectual Property

The website and its original content, including Eclipse branding, graphics, designs, photographs, videos, product artwork, text, logos, collection names and layout, are owned by or licensed to Eclipse and are protected by applicable intellectual-property laws.

You may use the website only for personal and lawful shopping purposes.

Without prior written permission, you may not:

  • reproduce or distribute our content for commercial purposes;

  • copy or manufacture products using our artwork;

  • remove copyright or trademark notices;

  • use Eclipse branding in a way that suggests affiliation or endorsement;

  • scrape or systematically extract website content;

  • resell digital copies of our artwork or product images;

  • create counterfeit or confusingly similar products.

Limited sharing of product pages through ordinary social-media features is permitted where the content is not altered and the source is accurately identified.

All rights not expressly granted are reserved.

20. Customer Reviews and Content

Where customers submit reviews, photographs, comments or other content, they confirm that:

  • they created the content or have permission to use it;

  • it is accurate to the best of their knowledge;

  • it does not infringe another person’s rights;

  • it is not unlawful, threatening, defamatory, discriminatory or misleading;

  • it does not contain malware, spam or unauthorised advertising.

The customer retains ownership of their content.

By submitting content to Eclipse, the customer grants us a non-exclusive, worldwide, royalty-free licence to use, reproduce, adapt, publish and display that content for operating, promoting and improving Eclipse, subject to applicable privacy and consumer laws.

We may moderate or remove content where reasonably necessary, but we are not obligated to publish every submission.

Any reward or incentive connected to a review must be disclosed as required by law.

21. Prohibited Uses

You may not use the website or Services to:

  • violate applicable law;

  • engage in fraud or unauthorised transactions;

  • infringe intellectual-property or privacy rights;

  • introduce malware or harmful code;

  • gain unauthorised access to accounts or systems;

  • interfere with website security or operation;

  • scrape or extract content at scale without permission;

  • impersonate another person;

  • submit false or misleading information;

  • harass customers, staff or third parties;

  • abuse promotions or payment disputes;

23. Shopify

Our store is hosted by Shopify.

Purchases from this store are made directly between the customer and Eclipse, not between the customer and Shopify.

Shopify provides the technological platform and may process personal information and payments as described in our Privacy Policy and Shopify’s applicable policies.

Shopify is not the seller of Eclipse products merely because it hosts the store.

24. Privacy

Our collection and use of personal information are described in our Privacy Policy.

By using the website, you acknowledge that personal information may be processed by Eclipse, Shopify and service providers involved in payment, fulfilment, analytics, customer support and store operation.

Customers should review the Privacy Policy before submitting personal information.

25. Website Availability

We aim to keep the website accurate, secure and available. However, we do not guarantee that it will always operate without interruption or technical error.

We may temporarily restrict or suspend parts of the website for:

  • maintenance;

  • security;

  • technical upgrades;

  • legal compliance;

  • events outside our reasonable control.

We are not responsible for minor temporary interruptions that do not affect an accepted purchase contract.

26. Disclaimer

To the fullest extent permitted by applicable law, general website content is provided for informational and shopping purposes and may occasionally contain non-material errors or omissions.

Nothing in these Terms excludes:

Any disclaimer applies only to the extent legally permitted.

27. Limitation of Liability

To the fullest extent permitted by law, Eclipse is not responsible for indirect or unforeseeable losses that were not reasonably foreseeable when the contract was formed.

Eclipse is not responsible for business losses suffered by a customer purchasing as a consumer, including loss of profit, revenue, business opportunity or commercial reputation.

Nothing in these Terms limits liability that cannot lawfully be limited, including liability for:

  • fraud or fraudulent misrepresentation;

  • death or personal injury caused by negligence where applicable;

  • intentional misconduct;

  • mandatory consumer guarantees;

  • other non-excludable legal obligations.

Where permitted by law, our liability will be limited to losses reasonably connected to the affected order or use of the Services.

28. Events Outside Our Reasonable Control

We are not responsible for failure or delay caused by events outside our reasonable control, such as:

  • natural disasters;

  • severe weather;

  • war, civil unrest or terrorism;

  • widespread transport disruption;

  • government action;

  • customs closures;

  • labour disputes not limited to our own workforce;

  • major telecommunications or platform failures;

  • public-health emergencies.

We will take reasonable steps to minimise the effect of such events.

This section does not remove rights a customer may have where delivery becomes excessively delayed or impossible.

29. Indemnity for Unlawful Use

Where permitted by law, a person using the website for unlawful commercial activity agrees to compensate Eclipse for reasonable losses directly caused by their deliberate violation of these Terms or the rights of another person.

This provision does not apply in a manner that unfairly restricts ordinary consumers or makes them responsible for losses they did not cause.

These Terms and contracts with Eclipse are governed by the laws of the Republic of Cyprus.

However, where you are a consumer residing in another country, this choice of law does not deprive you of mandatory consumer protections available under the law of your habitual country of residence where those protections apply.

Any dispute may be brought before the courts having jurisdiction under applicable law.

Nothing in this section prevents a consumer from bringing a claim in a court available to them under mandatory consumer-jurisdiction rules.

32. Severability

If any provision of these Terms is found unlawful, invalid or unenforceable, that provision will be applied to the fullest lawful extent or removed where necessary.

The remaining provisions will continue in effect.

33. No Waiver

A failure or delay by Eclipse in enforcing a provision does not waive the right to enforce that provision later.

A waiver is effective only where clearly given for the specific matter concerned.

34. Assignment

Customers may not transfer contractual rights or obligations in a manner that would prejudice Eclipse without prior written consent, except where applicable law permits such a transfer.

We may transfer our rights or obligations as part of a sale, restructuring or transfer of the business, provided this does not reduce mandatory customer rights.

35. Entire Agreement

These Terms, together with the policies incorporated into them, constitute the agreement governing use of the website and purchases from Eclipse.

If there is a conflict:

  • mandatory law takes priority;

  • specific product or promotion terms apply to the relevant product or promotion;

  • the Return and Refund Policy applies specifically to returns and refunds;

  • the Privacy Policy applies specifically to personal-information processing.

36. Product Imagery and Mockup Disclaimer

Product images, illustrations, and previews on our website are digital representations and design mockups created for visual reference. Some artwork or illustrations may utilize digital enhancement or AI-assisted tools during the design process.

Because each physical item is custom made/printed, the final product you receive may have slight variations in color, tag placement, scaling, or minor fine details compared to the website images. By placing an order, you acknowledge and accept these minor differences.

37. Changes to These Terms

We may update these Terms to reflect changes in:

  • our business practices;

  • website functionality;

  • applicable law;

  • payment or delivery services;

  • security requirements.

The updated version will be posted on this page with a revised “Last updated” date.

Changes will not unfairly alter an already accepted order or remove rights that existed when the order was placed.
